These Terms are the general rules for using YANO and requesting services. A proposal, order, invoice, statement of work, service agreement or other written agreement for a specific customer may contain additional terms. If a specific written agreement conflicts with these general Terms, the specific agreement controls for that service.
1. Acceptance of these Terms
By accessing or using the YANO website, submitting a request, accepting a proposal, ordering services or otherwise engaging YANO to perform services, you agree to these Terms to the extent applicable to your use or engagement.
If you are acting on behalf of a business or organization, you represent that you have authority to act for that business or organization.
2. YANO services
Depending on the plan, proposal or project, YANO services may include:
- Website planning, design and development.
- Managed website hosting and SSL.
- Domain connection and technical setup.
- Website maintenance and backups.
- Routine content updates.
- Basic search-engine optimization setup and housekeeping.
- Website monitoring and technical support.
- Website reviews and improvement recommendations.
- Other services specifically described in a proposal or agreement.
YANO may decline a project or request when we reasonably determine that it is outside our capabilities, presents unacceptable risk, violates law or third-party rights, or falls outside the agreed scope.
3. Plans and service scope
The YANO website may describe standard service plans, including Essential and Managed plans. Current pricing and included services are those disclosed to you when you agree to purchase the service.
Routine content updates generally include normal changes to existing website content such as:
- Text and copy changes.
- Images.
- Menus.
- Services and product descriptions.
- Pricing.
- Business hours.
- Similar changes to existing content.
Major redesigns, substantial new pages or sections, e-commerce systems, custom applications, databases, custom integrations and significant new functionality are not routine content updates and may require a separate quote.
4. Project timelines
YANO may publish or provide estimated project or update timelines, including a typical target of approximately 3–5 business days for straightforward website builds.
These are targets rather than guarantees. Timing may depend on project complexity, customer responses, receipt of content and access credentials, revisions, third-party systems and circumstances outside YANO's reasonable control.
Customer delays in providing information, approvals, content or access may extend a project timeline.
5. Customer responsibilities
You are responsible for providing information and materials reasonably necessary for YANO to perform the agreed services.
You represent that you have appropriate rights or permission to use material you provide to YANO, including:
- Business names and trademarks.
- Logos.
- Photographs and graphics.
- Written content.
- Video or audio.
- Testimonials.
- Product and service information.
You are also responsible for reviewing and approving factual information about your business, including prices, hours, policies, claims and contact information.
6. Domains and third-party accounts
Website services may depend on domain registrars, hosting infrastructure, email providers, analytics platforms, payment processors, content-management systems, software providers or other third-party services.
Where practical, business-critical accounts and domains should be maintained in the customer's name or under credentials that allow appropriate customer access.
YANO is not responsible for outages, policy changes, service termination, price changes or other failures caused solely by an independent third-party provider.
7. Pricing, billing and recurring services
Prices shown on the YANO website are subject to the scope, qualifications and exclusions stated with the applicable offer. Custom work may be separately quoted.
If you enroll in a recurring monthly service, you authorize the applicable recurring charge at the amount and frequency disclosed before purchase until the service is canceled.
Any setup charge, minimum service period, promotional rate, deposit, early-termination condition or other material billing term will be disclosed before you agree to the applicable paid service.
8. Cancellation
A recurring YANO service may be canceled using the cancellation method provided when the service is purchased or by sending YANO a clear written cancellation request through an available YANO contact channel.
Unless a specific service agreement states otherwise, cancellation prevents future renewal charges and service may continue through the end of the already-paid billing period.
Fees already earned for services performed or a billing period already underway are generally non-refundable, except where required by law or expressly agreed otherwise.
YANO will not intentionally make cancellation unreasonably difficult.
9. Payment failures
If a payment fails or an account becomes past due, YANO may contact the customer and may suspend non-emergency work or services until the account is brought current.
Before suspending a live customer website for nonpayment, YANO may provide reasonable notice when circumstances permit. A specific customer agreement may contain more detailed payment and suspension terms.
10. Ownership and intellectual property
Customer materials
You retain ownership of content and intellectual property you provide to YANO, subject to any rights belonging to others. You grant YANO permission to use that material as reasonably necessary to provide the requested services.
YANO materials
YANO retains ownership of its pre-existing tools, systems, reusable code, processes, templates, know-how and other materials developed independently of a specific customer project.
Project-specific work
Ownership, licensing and transfer rights for project-specific website files, custom development and other deliverables may be described in the applicable proposal or service agreement.
Third-party software, fonts, images, plugins, themes and other licensed materials remain subject to their respective license terms.
11. Website reviews
YANO website reviews are practical assessments based on publicly available website information, automated testing, third-party data and professional judgment.
A website review is not a legal opinion, legal compliance certification, security audit, penetration test or formal accessibility certification unless YANO expressly agrees in writing to provide such a service.
Automated systems can occasionally fail, return incomplete information or produce false positives. Review findings should therefore be treated as practical guidance rather than a guarantee.
12. Accessibility
YANO may design websites with accessibility-conscious practices and may identify or remediate common accessibility barriers.
Laws, technical standards, customer content and third-party systems can change. Unless expressly stated in a separate written agreement, YANO does not provide a legal guarantee or certification that a website satisfies every accessibility law, regulation, guideline or technical standard.
13. Search engines and business results
YANO may provide basic SEO setup, technical improvements and ongoing search-related housekeeping.
Search-engine rankings are controlled by third parties and depend on many factors outside YANO's control. YANO does not guarantee a particular ranking, traffic level, number of leads, sales volume or business result.
14. Website availability, backups and security
YANO uses reasonable practices intended to keep managed websites available, maintained and backed up.
No website, hosting service, network or backup system can be guaranteed to operate without interruption, data loss, security incident or technical failure.
YANO may perform maintenance, security work, software updates or emergency remediation when reasonably necessary to protect a website or underlying infrastructure.
15. Acceptable use
You may not knowingly use YANO services to publish, distribute or facilitate content or activity that:
- Violates applicable law.
- Infringes intellectual-property or privacy rights.
- Is fraudulent or materially deceptive.
- Distributes malware or malicious code.
- Attempts unauthorized access to another system.
- Creates unreasonable technical or security risks for YANO infrastructure or other customers.
YANO may suspend or refuse work associated with prohibited activity when reasonably necessary.
16. Confidential information and credentials
During a project, a customer may provide access to domains, hosting, content-management systems, business accounts or other systems.
YANO will use access credentials only as reasonably necessary to perform requested services and will take reasonable measures to protect credentials entrusted to us.
Customers should avoid sending passwords or highly sensitive information through ordinary public website forms.
17. Suspension and termination
Either party may end a service relationship as permitted by the applicable order or service agreement.
YANO may suspend or terminate services when reasonably necessary because of material nonpayment, unlawful use, serious security risk, abuse of YANO systems, or a material breach of an applicable agreement.
When reasonably practical, YANO will attempt to provide notice and an opportunity to address the problem before terminating a customer relationship.
18. Disclaimers
Except for commitments expressly stated in an applicable written agreement, YANO services are provided using commercially reasonable professional efforts.
To the fullest extent permitted by applicable law, YANO disclaims implied warranties that are not expressly provided in writing, including implied warranties of merchantability or fitness for a particular purpose where such disclaimers are legally permitted.
Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded.
19. Limitation of liability
To the fullest extent permitted by applicable law, YANO will not be liable for indirect, incidental, special, exemplary or consequential damages arising from use of the public website or services, including lost profits, lost opportunities or loss of data, except where such a limitation is prohibited by law.
Any specific service agreement may establish additional or different liability terms appropriate to that engagement.
20. Third-party services and links
YANO websites and services may use or link to products and services operated by third parties. Those third parties control their own services, availability, terms, pricing and privacy practices.
A link to or integration with a third-party service does not mean YANO guarantees or controls that service.
21. Governing law
These general Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles, except where applicable law requires otherwise.
A specific customer agreement may contain additional dispute-resolution or venue provisions.
22. Electronic communications
You agree that communications, proposals, approvals, notices and agreements may be provided electronically when permitted by applicable law.
Electronic acceptance, including an electronic signature, online acceptance or other affirmative electronic action, may be used to document agreement to a service or transaction.
23. Changes to these Terms
YANO may update these Terms as our services, technology or legal requirements change.
Updated Terms will be posted with a revised effective date. Material changes affecting an existing paid service will be handled consistently with the applicable customer agreement and applicable law.
24. Contact
Questions about these Terms may be sent to YANO using the contact or service-request methods available through the YANO website.
